Supermarket Customer Suffers Serious Shoulder Injury in Slip and Fall Accident

This case involves a slip and fall accident at a major grocery retailer in Florida that resulted in serious injuries. On the date of the incident in question, the plaintiff was shopping in the frozen foods section of the supermarket. At the same time, a worker from a company that the supermarket had contracted cleaning services from was finishing his work in cleaning the store. As a part of his cleaning duties, the man had removed a number of non-slip mats from a number of key locations from around the store. One of these mats had previously been located in front of a freezer that contained bags of ice, which had been leaking onto the floor for the past several weeks. The customer eventually walked past the freezer and slipped on a puddle of water that had accumulated in front of it, falling and suffering significant injuries to her shoulder. It was alleged that the store allowed an unsafe condition to exist during the time that the floor mat was removed.

inline imageIn my management experience of supermarkets, I designed safety protocols as well as wrote safety manuals that spanned the whole supermarket environment including the parking lot. I am familiar with hiring cleaning contractors as well implementing floor mat programs. In this case, there was negligence in that a dangerous environment was created. Without the floor mats, the floors should have been secured in some other way during the cleaning operation.
