Investment Firm Accused of Charging Excessive Fees to 401(k) Clients

This case involves allegations against a large financial and banking firm in relation to the management of its own 401k plan. Specifically, the plaintiffs allege that the defendant (1) caused plan participants to pay excessive fees for administrative and recordkeeping services and (2) included imprudent investment options that caused plan participants to suffer significant losses. We require a data expert who can opine on the financial losses suffered from the investment selections included in the 401(k) Plan. The ideal candidate will have extensive experience with handling and analyzing a significant volume of investment and transactional data.

inline imageI am very familiar with these subjects. I can certainly opine on the administrative/recordkeeping fees - I did the pricing for T. Rowe Price as a recordkeeper for several years, and I have presented at many conferences on the topic. I'm also knowledgeable on the investment side. My expertise is focused on recordkeeping, fees, revenue sharing, and fee leveling, among other areas. I have a tremendous amount of experience with the use of data to properly account for those things. I can add considerable depth to your team on recordkeeping and the calculations related to that area, as well as on the calculations related to the damages. When I was doing this work for T. Rowe Price, I was responsible for managing the people who dealt with the data. Essentially, I was a business liaison to the data and product development teams. I also have a background in law and often served as the business representative for T. Rowe Price in legal proceedings. I am intimately familiar with this process and can help with respect to discovery as well.
