I have been providing expert witness services in podiatry malpractice cases since 1993. These 15 questions are an example of what I am typically asked during depositions and testimony:
1. How long have you been doing case reviews?
2. How many times have you testified/been deposed for the plaintiff? For the defendant?
3. What, if any, are your board certifications?
4. Did you pass the boards on the first attempt?
5. Do you have experience/training to do this particular surgery?
6. How many times have you performed the procedure in question or treated this condition? How many times per year since residency?
7. How many times have you worked with this attorney?
8. What are the names of the companies with whom you have signed up with to perform expert review?
9. Do you advertise?
10. Have you reviewed your CV and is it current?
11. What is your fee schedule?
12. What percentage of your annual income can be attributed to your work as an expert witness?
13. What date did you receive the medical records from the attorney? What date did you start your review?
14. Have you ever been sued for malpractice? What were the results?
15. Have you ever been denied or revoked hospital surgical privileges?
