Failure to Treat Advanced Multiple Sclerosis

This case involves a 40-year-old male who developed signs and symptoms consistent with that of Multiple Sclerosis and is currently under the care of a neurologist. The patient underwent a spinal tap and had MRI imaging of the brain; all results pointed to that of MS. The patient’s initial neurologist never made a definitive diagnosis of MS and explained to the patient that his disease was a clinically isolated state and suggested that he wait to start preventative treatment. The patient’s condition deteriorated over the next year which led him to get a second opinion; the patient started interferon treatment soon thereafter.

Question(s) For Expert Witness

The attorney is looking for a physician to review the medical records, determine if a breech in standard of care exists, and explain any known benefits of early intervention.

Expert Witness Response E-000135

inline imageI am happy to take on this case as I feel it requires a careful record review of the care of the first neurologist. The years during which the care took place are crucial as the literature and standard of care for MS diagnosis and treatment have changed over time. This necessity relates to verification of disease progression as well as the need to have the proper MS categorical diagnosis, such as remitting-relapsing v. one of the progressive forms. Additionally serial MRI's must be compiled and possibly re-examined / reviewed for an expert neuro-radiological opinion. In addition, neuropsychological testing may be necessary to demonstrate progression in the cognitive sphere.
